Cabaret Law:
Activists are trying to do something, anything, to overturn or change an archaic 1926 law licensing dancing that the Giuliani administration—and now the Bloomberg administration—have used to combat quality-of-life complaints and troublesome clubs.

An Important Announcement from SWING46

March 25th 2003
Dear Friends,
SWING46 has been in operation for 6 years, since June of 1997.
We Specialize in music + dance from the "Swing Era" of New York in the 1930’s + 40’s.
Including being home to the beloved "Buster Brown Tap Jam" Every Sunday afternoon – Which is The Longest Running Jam - in the History of New York!
Last week the Dept. of Consumer Affairs closed us down for Dancing
We are no longer permitted to teach the Great American Art Forms of Jazz, Tap & Lindy.
SW46 has never had any complaints - We offer a warm and peaceful communal experience
We have hosted Master Tap Dancers, Champion Swing and Lindy Hop Dancers, Grammy Award Winning Musicians, Writers, Composers and Arrangers that have worked consistently with us and need us to be here.
This venue has been home to music and dance for almost 40 years.
We have been commended with distinction as an asset to Times Square and New York City! And we are humbled in having being able to do so for 6 long years.

SWING46 is in a very small Zone known as C1-5 R/8: A commercial and residential zone that runs just Restaurant Row - 46 St. Btw. 8th + 9th and onto 9th Avenue from 43rd to 56th St. Which is why we would not be successful in an application for Cabaret Licensing.
The Buildings Dept. Require we change our "Use Group" From existing Use Group 6 – Restaurant Eating & Drinking To use group 12 Cabaret. (dancing permitted in association) The use group change comes from the Dept. of Consumer Affairs.
Consumer Affairs won’t grant it because of the zone we are in. At the end of the street is a licesensed Cabaret – but they are on the 8th Ave. corridor - which is in a different zone.
How Could You Help? It’s a long shot – but maybe by emailing: Info@swing46.com with a paragraph or two on why you think SWING46 Should be allowed to continue and what your experience has been here over the years, we can present your voice to the Mayor’s Office.
We should be respectful – although the Laws are in place, If the Mayor deems fit, He could grant us the exception we need - because of the type of place we are and what we do for American Culture – Remember it would be a great favor to be given this variance to the Land Use laws – regarding dancing at SWING46 Specifically.
